Question: A man was playing around with his wife during the day in Ramadhaan; this progressed to kissing and passionate foreplay between her thighs and the subsequent ejaculation of pre-seminal fluid and not semen. So is his fast invalidated by that? [Additionally], if he is unable to recall the number of [fasting] days he did that, how can he find out; Bearing in mind a number of years have now passed since that happened, i.e. the passing of one Ramadhaan and then the one after it [and so on]. So what should he do?
Response: Whenever a fasting man engages in sexual foreplay without progressing to intercourse, and as a result he ejaculates semen or pre-seminal fluid, then all he is required to do is make up the fast for that day. And if he does not remember exactly how many days [this occurred], then he is required to err on the side of caution with respect to the fasting – until such time he is certain of having made up the number of invalidated fasts. As a few years have now passed since this occurred whilst he was ignorant of its ruling, then all he is required to do is to make up the fasts for those days.
However, if he was aware that this [sexual foreplay without intercourse resulting in the ejaculation of semen or pre-seminal fluid] had invalidated his fast, and year after year he continued to delay making up the invalidated fast[s], then in addition to making up the invalidated fast[s], he is required to feed a poor and needy person for every invalidated fast. And Allaah [alone] has the Complete knowledge [of all affairs].
